Introduction 

NG ApS is the owner of the Nordgreen brand and website. In the following the company is just referred to as Nordgreen.

Throughout the site, the terms “we”, “us” and “our” refer to Nordgreen. Nordgreen offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here. 

These Terms and Condition governs your purchases from, and your use of, the www.nordgreen.com website and forms a contract between you and NG ApS (45739589), Løngangstræde 37, 1., 1468 Copenhagen, Denmark (hereinafter “Nordgreen”). By making a purchase from, and using this website, you have agreed to these Terms and Conditions. Please make sure that you have read and understood these Terms and Conditions when using our site. 

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

International orders
Orders shipped to countries outside Denmark are processed by our partner Global-e, which acts as the Merchant of Record (the seller) for these orders. Global-e handles payment, duties and taxes, and refunds for your order. For international orders, Global-e’s Terms of Sale and Consumer Privacy Policy apply in addition to these Terms. If they conflict, Global-e’s Terms of Sale prevail.

1. Confirmation

 

Once Nordgreen has received your order, Nordgreen will send an electronic invoice to your e-mail address as a confirmation of your purchase. It is important that you enter the correct e-mail address when placing your order. Nordgreen recommends saving this confirmation email in order to facilitate any contact with customer service you may have in the future. The order confirmation (receipt) also serves as a guarantee of proof of purchase.
You will also receive an email that confirms that the order has been dispatched (the shipping confirmation).We reserve the right to refuse any order you place at our sole discretion.

 

1. Payment
   You may pay with either credit or debit cards as well as PayPal and depending on the country your order to other payment solutions like Klarna, Apple Pay and Google Pay will also be available. All payments are securely encrypted and underlie strict banking standards. Nordgreen does not store any credit card numbers.

 

1. Payment by card
   Pay with your Visa, mastercard, Maestro or Unionpay securely over the Internet. Your card details are sent directly to the bank and cannot be read or accessed by anyone other than your bank. There is no extra charge for card payments unless the customer’s bank charges a fee to the customer. When paying by credit / debit card, starting conditions apply as soon as the card transaction is approved. In the event that no payment has been received after submitting your order, Nordgreen may automatically cancel your order.

 

1. Payment with Klarna - Flexible Payment

Klarna is a payment method which allows you to buy NOW and pay LATER. This means that you can place an order, try the items on, and return any unwanted items and then only pay for the items that you keep.

How do I pay using Klarna?

To pay using Klarna, you'll need to provide your mobile number as they may need to contact you. We'll also need your email address so that Klarna can send your payment statement. It's important that you provide the correct details, as you won't receive the relevant payment information otherwise.

If you choose to pay with Klarna - Slice it in 4, additional terms will apply between you and Klarna. These terms are presented at checkout. The issuer of your card may charge interest or other fees under the terms of your card agreement.

 

1. Promo codes
   Promo codes should be entered during the checkout process to be valid. Attempting to add a promo code after purchase will not be honored. 

 

1. Taxes
   All prices shown on www.nordgreen.com include VAT where applicable. In some markets, such as the US, local sales tax is added at checkout. For international orders, duties and taxes are calculated and collected by Global-e at checkout, so there are no additional fees on delivery.

Please note that in case an order is shipped to a delivery address outside the EU, you may be subject to import duties and taxes, which are collected when the shipment reaches your delivery address. You will be responsible for payment of such import duties and taxes. It should be noted that Nordgreen has no control over these charges and, since these charges are different for different countries, Nordgreen cannot predict their amount. Nordgreen advises you to contact your local customs office for further information.

 

1. Ordering and returns
   
   Orders made in another person's name without the person’s consent, will be reported to the authorities. Nordgreen holds the right to change prices, correct incorrect prices on all orders as well as final sales. If a price is incorrect, this may compel Nordgreen to cancel the purchase and refund any amount paid in the best way. This can be performed at any time.
   You can request a return within 30 days of the delivery date via our returns portal: https://portal.returngo.ai/?shop=nordgreen-watches.myshopify.com. The 30-day return applies to unused products. Returns must be sent within 14 days of your return request, and pre-paid return labels must be used within 7 days of their creation date. If you use our pre-paid label, a return shipping cost of EUR 7, or the equivalent in your local currency, is deducted from your refund. If you cancel or return your full order under the right of withdrawal in the EU/EEA or the UK, we refund the original standard delivery cost. Duties and taxes are refunded where they are included in the product price or where required by law. For international orders, Global-e’s Terms of Sale apply. If a product is defective, damaged on arrival or incorrect, please submit a warranty claim in our returns portal. Please refer to our Return Policy for further information.
   

 

1. Warranty
   

   Warranty term: two years from the date of delivery. The warranty covers manufacturing defects on watches and straps purchased directly from Nordgreen, including international orders processed by Global-e. To make a warranty claim, please submit a claim in our returns portal with a description of the issue and photos or a video.

   The warranty does not cover:

   • Failure or damage caused by improper use or carelessness (e.g. dents, crushing, broken crystal)
   • Failure or damage caused by unauthorised repair or modification
   • Failure or damage caused by fire, water beyond the stated water resistance, or natural disasters
   • Aesthetic changes from normal wear and tear and ageing (e.g. minor scratches on the case or crystal, colour changes on the strap, peeling of the plating)
   • Battery replacement
   • Loss of the product

   The case, dial, hands, crystal, strap or other parts may be replaced with equivalent parts if the originals are not available. This warranty does not restrict your statutory rights as a consumer.

    

1. Privacy policy
   We will treat all your personal information as confidential and will only use it in accordance with our Privacy Policy (see Section 2). In addition, we will process information about you in accordance with our Privacy Policy (see Section 2). By using our Website, you consent to such processing and you warrant that all data provided by you is accurate.
   When you shop on this Website, we will ask you to input personal details in order for us to identify you, such as your name, e-mail address, billing address, delivery address, credit card or other payment information. We confirm that this information will be held by us in accordance with the registration we have with the Data Commissioner's office.

 

1. Product
   Nordgreen has the right to adjust prices, involve additional cost and change product information such as product pictures and offers without notice. The product images and information texts available reflect the product as much as possible. We reserve the right for any errors that may appear on the page and cannot guarantee that all pictures accurately reflect the true appearance of the watch. The pictures may differ depending on the color settings in your computer. All pictures should be seen as illustrations only, and do not guarantee correct appearance and characteristics.

 

1. Delivery and cancellations
   Your order will normally be delivered in 4 - 6 working days after you have placed your order. Nordgreen ships worldwide. Deliveries are made in cooperation with postal services and their partners. You can cancel your order free of charge before it has been dispatched via our returns portal. Once your order has been dispatched, you can return it after delivery in accordance with our Return Policy. The customer is responsible for the risk of transporting returned products to Nordgreen if they do not use the pre-paid return label provided by Nordgreen.

2. Complaints terms
   Please check your products carefully when you receive your shipment. If your product is damaged in transport, whether the damage is visible or hidden, please report it to the carrier as soon as possible. If your product is damaged, defective or does not match your order, please submit a claim in our returns portal as soon as possible, and include your order number, a description of the issue and photos or a video. If we ask you to return a defective product, please pack it so it cannot be damaged during transit. Nordgreen may replace defective goods with goods of the same model. If the item has been discontinued, you will receive an equivalent replacement or a full refund.

1. Liability
   Nordgreen responsibility for errors in connection to delivery is limited to existing conditions of sale. Nordgreen bears no direct or indirect responsibility for example, but not limited to, incompatibility, delivery delays, downtime, data loss, additional work or other economic harm.
   We warrant to you that any product purchased from us through our site is of satisfactory quality and reasonably fit for all the purposes for which products of the kind are commonly supplied and will remain so for a period of 24 months from the date of delivery.
   Our liability for losses you suffer as a result of us breaking this agreement is strictly limited to the purchase price of the product you purchased.
   This does not exclude or limit in any way our liability:
   For death or personal injury caused by our negligence;
   For fraud or fraudulent misrepresentation; or
   For any matter for which it would be illegal for us to exclude, or attempt to exclude, our liability.
   We are not responsible for indirect losses which happen as a side effect of the main loss or damage, including but not limited to:
   Loss of income or revenue;
   Loss of business;
   Loss of profits or contracts;
   Loss of anticipated savings;
   Loss or corruption of data; or
   Waste of management or office time
   However arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

 

1. Use of website
   The Website is provided on an 'as is' and 'as available' basis without any representation or endorsement made and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the Website and any information provided by you. You must bear the risk associated with the use of the Internet.
   Whilst we will try to ensure that material included on the Website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience with the Website. If we are informed of any inaccuracies in the material on the Website we will attempt to correct this as soon as we reasonably can.
   In particular, we disclaim all liabilities in connection with the following:
   Incompatibility of the Website with any of your equipment, software or telecommunications links;
   Technical problems including errors or interruptions of the Website;
   Unsuitability, unreliability or inaccuracy of the Website; and
   Failure of the Website to meet your requirements.
   To the full extent allowed by applicable law, you agree that we will not be liable to you or any third party for any consequential or incidental damages (both of which terms includes, without limitation, pure economic loss, loss of profits, loss of business, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to your use of the Website.

 

1. Force majeure
   Nordgreen shall be exempt from liability for damages and other penalties on the performance of the contract prevented, hindered or delayed by circumstances beyond our control. As the release factor should be considered include government intervention, new / amended legislation, lack of state, war, fire, flood, labor disturbance, prohibitions, restrictions, sabotage, poor transport or weather conditions or lack of delivery from suppliers and the company is exposed to criminal activity that affects activities.

 

1. Site usage policy and intellectual property rights
   (A) SECURITY
   You are prohibited from violating or attempting to violate the security measures on the Site, including, without limitation:
   1. Using a false password or one belonging to another user or accessing data not intended for the user or logging into a server or account which such user is not authorized to access;
   2. Disclosing a password or permitting a third party to use a password or failing to notify us if a password is compromised;
   3. Attempting to probe, scan or test the vulnerability of the system or network or to breach security or authentication measures without proper authorization;
   4. Attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding", "mail bombing" or "crashing";

   You agree to use the Site only for lawful purposes and only for your own personal, non-commercial use.    We have absolute discretion to determine if any use violates these rules, and to act as we deem appropriate in the event of any violation. Violations of system or network security may result in civil or criminal liability. We will investigate occurrences which may involve such violations and may involve, cooperate with, and make disclosures to, law enforcement authorities in identifying and prosecuting users who are involved in such violations.

   Unless otherwise noted, all materials, including images, illustrations, designs, icons, photographs, audio, video clips, text, "look and feel", layout, graphics, messages, files, documents, and written and other materials that appear as part of the Site (collectively, the "Contents") whether publicly posted or privately transmitted, as well as all derivative works are property owned, controlled, licensed or used with permission by Nordgreen owner of the Nordgreen Brand, and/or its parents, subsidiaries and affiliates (collectively, "Nordgreen") or other parties that have licensed to or otherwise permitted their material to be used by Norgreen. The Site as a whole and its Contents are protected by copyright, trademark, trade dress and other laws and all worldwide right, title and interest in and to the Site and its Contents are owned by Nordgreen or used with permission. Nordgreen.com, Nordgreen, the Nordgreen logos, and all other trademarks appearing on this Site are trademarks of Nordgreen or are licensed or used with permission of the owner by Nordgreen. You agree not to display or use such trademarks without Nordgreen prior written permission. Nordgreen disclaims any proprietary interest in trademarks, service marks, logos, slogans, domain names and trade names other than its own.
   The Contents of the Site, and the Site as a whole, are intended solely for personal, non-commercial use by the users of the Site and may not be used except as permitted in these Terms of Conditions. You may share content from the Site with the use of the social media links (i.e. “Share:” “Pin It” and “Tweet”) provided on our Site. You may also share content from the Site via email through the use of our Email a Friend link. You may download or copy the Contents and other downloadable materials displayed on the Site for your personal use only. No right, title or interest in any downloaded materials or software is transferred to you as a result of any such downloading, sharing or copying. Except as noted above, you may not reproduce, republish, publish, upload, post, transmit, distribute (including by email or other electronic means), publicly display, modify, create derivative works from, sell or participate in any sale of, or exploit in any way, in whole or in part, any of the Contents, the Site, or any related software without the prior written consent of Nordgreen or the owner of such material. We may update the content on this Site from time to time, but its content is not necessarily complete or up-to-date. 1. User content
   The www.nordgreen.com website may include user generated content, for example social media applications. Nordgreen does not claim any ownership in rights in such content (images, photos and videos etc.) And take no legal responsibility for it. In case you suspect a violation of copyright, or any other right, or otherwise is offended by such content, please contact our customer service.

 

1. Reviews
   If you submit a review, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sub-licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
   You grant Nordgreen and its sub-licensees the right to use the name that you submit in connection with such content, if they choose.
   You agree to waive your right to be identified as the author of such content and your right to object to derogatory treatment of such content.
   You agree to perform all further acts necessary to perfect any of the above rights granted by you to Nordgreen, including the execution of deeds and documents, at the request of Nordgreen.
   You represent and warrant that you own or otherwise control all of the rights to the content that you post; that, as at the date that the content or material is submitted to Nordgreen: The content and material is accurate;
   Use of the content and material you supply does not breach any applicable Nordgreen guidelines and will not cause injury to any person or entity (including that the content or material is not defamatory). You agree to indemnify Nordgreen for all claims brought by a third party against Nordgreen arising out of or in connection with a breach of any of these warranties.

   To the extent that this Site contains links to outside services and resources, including other websites, the availability and content of which Nordgreen does not own, operate or control, any concerns regarding any such service or resource, or any link thereto, should be directed to the particular outside service, resource or website. Nordgreen makes no representations or warranties concerning and is not responsible for the content, information or other material on or accessed from any other websites that are not owned, operated or controlled by Nordgreen. 1. Retention of title
   All products remain in Nordgreen property until full payment is made.

 

1. Fraud
   All frauds are reported to the authorities and Nordgreen reserves the right to cancel the purchase if any suspicion is raised.

 

1. Governing law and jurisdiction
   These terms and your use of the www.nordgreen.com website are governed, construed and enforced in accordance with the Danish law.

 the Danish law. To the extent permitted by law, Danish courts shall have exclusive jurisdiction of any dispute arising from these terms of use and your use of the website, subject to Nordgreen’s right to prosecute a user at his/her place of residence.

 

1. Termination
   Nordgreen reserves the right to terminate your account and/or your use of the www.nordgreen.com website at its sole discretion. For example, if Nordgreen suspects that you have breached these terms of conditions. Such termination can be made without prior notice.

 

1. Amendments
   Nordgreen may revise these terms of conditions from time to time. Every time you order a product from us, the general conditions in force at that time will apply to the contract between you and Nordgreen. You should therefore periodically visit this page to review the then current terms to which you are bound.
